According to Vedomosti, on July 21, the National Federation of the Music Industry asked the chairmen of the State Duma committees on Information Policy and Financial Market, Alexander Khinstein and Anatoly Aksakov, to create legislative conditions for blocking payments by individuals to pirated resources and their owners. The NFMI in its appeal also made proposals to finalize the draft law on amendments to Federal Law No. 115 on countering money laundering.
Payments to pirated resources, according to the NFMI, exceed 5 billion rubles per year (talking about the sale of illegal copies of musical works, films, TV series and other content), the letter states.
In the letter, the NFMI points to a gap in the legislation: Article 7 of the Federal Law "On Countering the legalization of proceeds from Crime and the Financing of Terrorism" provides for blocking payments only in favor of sites that are included in the Unified Register of Prohibited Sites of Roskomnadzor (RKN). But with regard to pirated sites, access to which is restricted as a result of interaction between the RKN and telecom operators (interim measures against content through the decision of the Moscow City Court following a single violation), this mechanism does not work. The fact is that only those resources that were "permanently blocked" after two decisions of the Moscow City Court on copyright infringement fall into the register of the RKN.
The Federation proposes to add to Aksakov's bill (introduced on July 6, amendments to Article 7 of the aforementioned Federal Law) a clause stating that banks should block payments to pirated resources that are not included in the Unified Register of the RKN, but have already received access restrictions (i.e. after the copyright holder's appeal to the Moscow City Court and the first court decision). The procedure for interaction of banks with the RKN information system and telecom operators, according to the amendments proposed by the NFMI, should be established by the RKN in agreement with the Central Bank.
