Films, TV series and other similar content should not be subject to the regulation of orphan works, according to the Media and Communication Union (MKS). As reported by the Kommersant newspaper, the organization uniting TV channels and telecom operators is asking to involve its representatives in the work on the bill. The MKS, like representatives of the music industry, also advocates recognizing only old works as orphan, and not just orphan works.
The Media Communication Union (unites Channel One, Rostelecom, MTS, Tricolor, VGTRK, Gazprom-Media, etc.) sent a response to the draft law on the use of works with an inaccessible copyright holder (orphan), the organization told Kommersant. The Union, in particular, suggests that complex and composite works, that is, audiovisual (films, TV series, animations, etc.), multimedia products, theatrical productions, and various collections, should not be considered orphan.
The National Federation of the Music Industry has already criticized the current version of the bill. In particular, they propose to introduce a "limitation period" for intellectual property objects that can be recognized as orphan, as well as to clarify the definition itself.
There are similar provisions in the position of the MKS: the Union considers it correct to recognize as orphaned only works "in respect of which the absence of copyright holders has been reliably established," and to regulate those of them "since the first publication of which a significant amount of time has passed."
The MKS also requests that its representatives be included in the working group on the development of the initiative as a whole. The group, according to Nikita Danilov, Director General of the NFMI, has not yet been created: "We hope for a public discussion of the initiative."
