The Commission for the Implementation of the Code of Ethics in the Field of Artificial Intelligence has prepared "Ethical recommendations in the field of creating and using digital imitations of living, deceased and non–existent people" (hereinafter also referred to as the "Recommendations"). The document aims to provide guidelines for the creation and use of digital imitations, taking into account ethical standards. The recommendations can be used as a guide for developers, researchers and users of artificial intelligence (AI) algorithms, as well as for anyone directly or indirectly involved in the development and application of digital services based on them.
The Recommendations are an act of self-regulation, i.e. they are not binding, unlike the law. But they can be considered as a business practice, and if the copyright holder detects violations of the Recommendations by one of the signatories of the Code of Ethics in the Field of Artificial Intelligence (the full list is posted here: https://ethics.a-ai.ru /) it is possible to appeal to the provisions of the Code and the Recommendations.
Among the principles laid down in the Recommendations:
- digital imitations should not be created and used without human consent;
- the creation of a digital imitation (its duplicate) of a deceased person in public use / broadcast is possible if there is a lifetime consent of the person. The creation and use of such imitations by a limited circle of persons (for example, relatives, friends) without the consent of the deceased person is an ethical choice of these persons;
- the transformation of a digital imitation of a particular person (people) or the use of its individual elements to create a new digital imitation is allowed if the newly created imitation cannot be identified with the original personality (personalities) and the rights to the external image, voice and other unique personality traits (parameters) of the original are not violated. Otherwise, it is necessary to ensure that consent is obtained;
- it is recommended that during the broadcast of the results of the digital simulation, it is necessary to constantly and explicitly inform that a digital simulation artificially created by an AI algorithm is being broadcast. Thus, content that fully or partially represents a digital imitation of a person should be marked. The document also contains recommendations on such marking.
